Pinkerton Guard in custody over fatal shooting at Denver protests

A Pinkerton agent shot a far right protester a denver protest. It will be interesting watching if people try to call him a leftist. Not using it as the thumb because of it showing death, but main reason im posting is photoset of the incident Helen Richardson of the Denver post may get a pulitzer this year.

Honestly, I can see the verdict going either way. If the jury decides that there was enough evidence that the guard feared for his life, he could be found not guilty through self defense. On the other hand, what led up to the incident could cause it to go the other way. The article said that he was not in uniform, which the pictures support, and that they couldn't find his name on a list of thousands of licensed security guards.

I'm really curious on how this turns out.

Objectively, it doesn't look that good, since the other guy is armed with mace, which the court will find incapacitating but (mostly, reasonably considered) non-lethal.

But if the test is "reasonable fear for life", and the other person said something like "I'm going to kill you", and reaches for a weapon (which turned out to be the mace), the guard can claim that it looked like a lethal threat through his weapon's sights. Were this person a police officer, it would be hard to imagine this going to trial.

I thought murder in the first degree require premeditation?

Depends on state law. Generally murder involves "malice aforethought" which is a bit different from premeditation ( think of a premeditated killing done without malice for example a doctor pulling a plug). The premeditation involved doesn't have to be for more than an instant if malice is present. Deciding with malice ( as opposed to say self defense, defense of others) to kill someone and acting on it immediately is still murder, but the level of premeditation can effect the "degree." The classic examples that raise the level are things like laying in wait, poison, arson, and such things that require planning. The idea being that at anytime the person could have stopped their evil plan and not committed murder.

I wouldn't worry too much about the degree they say there are investigating him for. The charges will ( assuming an ethical DA) reflect what the evidence can prove.
