The idea isn't as simple as the headline. The thinking is that social/peer pressure is one of the strongest constraints on deviant behavior. But when you ostracize and banish offenders, they no longer have that pressure to act according to social norms. When gangs are illegal, it doesn't make gang members reconsider their actions. They just form their own micro-society with their own social norms that don't match with the norms of society at large. It's not as simple as, "Make crime legal!"

As the title states, this is not about legalizing crime but rather not criminalizing the poor.
Spending a fraction of the law enforcement budget on social work helps giving communities a perspective. Given this perspective, people naturally choose other means than crime to attain well-being. |
